EZINDRA Terms of Service
These Terms govern use of EZINDRA by users outside Poland and apply from 2026-08-20.
1. Provider, Terms and contact
The service is provided by Albert Fiksak, Długa 8a 32-830 Wojnicz (the “Provider”). Contact: contact@ezindra.com, tel. +48530080962.
These Terms govern access to and use of EZINDRA by users outside Poland. They are made available before the agreement is concluded in a form that allows the user to save and reproduce them.
2. Contract formation and authority
The agreement to use EZINDRA is entered into between the user and the Provider when the user creates an account and accepts these Terms, subject to the separate terms governing a paid subscription transaction handled by Paddle.
If the user uses EZINDRA on behalf of a business, company, organisation or other entity, the user represents that they have authority to bind that entity to these Terms. In that case, references to the user also include that entity where applicable.
Acceptance of these Terms is recorded electronically together with the document version and information reasonably necessary to evidence formation of the agreement.
3. Service scope
EZINDRA is a SaaS service supporting, among other things, the creation and handling of quotes, management of clients, pricing, quote data, documents, PDF files and work history, together with other functions made available in the application.
EZINDRA is a work-support tool. The Provider does not provide legal, tax, accounting or other regulated professional advice through EZINDRA and does not guarantee that content or documents created by the user satisfy requirements specific to the user's industry, transaction or legal obligations.
4. Technical requirements
Using EZINDRA requires a device with Internet access, a current version of a commonly used web browser supporting JavaScript and the mechanisms required for authentication and secure operation of the application, and an active email address. Downloading, printing or previewing PDFs may require suitable PDF support on the user's device.
The user is responsible for their Internet connection, device, software and secure configuration. The Provider may discontinue support for obsolete or insecure software versions where reasonably justified by security, technical compatibility or proper operation of the service.
5. Accounts and acceptable use
Users must provide a valid and current email address, keep login credentials secure and not make them available to unauthorised persons. A user is responsible for activity carried out using the account only to the extent that responsibility results from the user’s act or omission and applicable law. If unauthorised access is suspected, the user should promptly secure the account and inform the Provider.
Users must not provide unlawful content or use EZINDRA to violate law or third-party rights, bypass security, obtain unauthorised access, introduce malicious code, disrupt the service, impose excessive automated load on infrastructure, or otherwise endanger the security or availability of EZINDRA.
The user is responsible for the lawfulness of data, content and instructions submitted to EZINDRA and for having the rights or other lawful basis necessary to use them.
6. Trial, complimentary access, subscription and Paddle
Where a 7-day free trial is available for an account, it starts after the Paddle checkout is completed and a payment method is added. No plan charge is taken during the trial. Unless the subscription is cancelled before the trial ends, the selected paid plan starts after the trial on the terms shown before the order is confirmed.
The Provider reserves the right, at its discretion, to grant selected users individual complimentary access to all or part of EZINDRA for a fixed or indefinite period. Complimentary access may be granted in particular for promotional, testing, collaboration, partnership, demonstration, support or customer-service purposes, or on the basis of individual arrangements with the user. Granting complimentary access to one user does not oblige the Provider to grant the same or similar access to other users or to extend it.
Complimentary access does not result in charges or automatically start a paid subscription. Its scope, duration and any specific conditions may be specified when it is granted. Unless otherwise agreed on a binding basis when access is granted, complimentary access granted for an indefinite period may be limited or ended by the Provider for a valid reason, including the end or modification of the programme under which it was granted, a change in the scope of the service, abuse, breach of these Terms, security considerations, or material technical or organisational reasons. Where applicable law requires advance notice, preservation of access for a specified period or grants the user other mandatory rights, those rights remain unaffected.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle’s applicable Buyer Terms govern the transaction, while use of EZINDRA is governed by these Terms. Paddle handles payment, transaction-related taxes and refunds in accordance with applicable law, its Buyer Terms and Refund Policy.
Paid subscriptions renew in accordance with the billing period and terms presented before purchase unless cancelled beforehand. The price, currency, taxes, billing frequency and other transaction information are presented before confirmation; Paddle's applicable buyer terms also apply to the transaction.
7. Cancellation, withdrawal and refunds
The user may cancel a paid subscription using the method made available for the account or through the applicable Paddle channel. Unless mandatory law provides otherwise, cancellation generally takes effect at the end of the current billing period and prevents charges for subsequent renewals.
Detailed rules concerning the trial, cancellation, statutory withdrawal rights and refunds are set out in the Cancellation, Withdrawal and Refund Policy, which should be read together with these Terms and, for Paddle transactions, Paddle's applicable terms.
8. Consumers and digital-service conformity
Consumers, and any other users to whom applicable law grants equivalent mandatory protection, retain all rights that cannot lawfully be excluded or limited by contract.
To the extent required by applicable law, the Provider is responsible for conformity of the digital service with the contract and provides updates, including security updates, required to maintain that conformity. If the service lacks conformity, a consumer may use the remedies provided by applicable law, which may include bringing the service into conformity, a proportionate price reduction, or termination or withdrawal from the contract where applicable. The user should install or enable required updates where action on the user’s side is necessary and the user has been properly informed.
9. User data and AI Support
Users retain their rights in data and content submitted to EZINDRA. They grant the Provider only the rights to store, process, display, transmit and perform other technical operations with that content that are necessary to provide, secure and maintain the service and to perform user-requested operations.
If the user uses AI Support, the user is responsible for content submitted in the message and should not provide data that they are not entitled to disclose. Processing related to AI Support is described in the Privacy Policy.
AI responses may contain errors or inaccuracies and should be verified before being relied upon for important decisions. AI Support is not legal, tax, accounting or other professional advice.
10. Rights in EZINDRA
Rights in the EZINDRA application, its code, visual design, graphics, branding and other materials belong to the Provider or the relevant licensors. These Terms do not transfer those rights to the user.
For the duration of the agreement, the Provider grants the user a non-exclusive, non-transferable right to use EZINDRA in accordance with these Terms. The user must not copy, resell, present the service as their own, bypass technical restrictions or attempt to derive source code, except to the extent such restriction is prohibited by mandatory law.
11. Personal data, privacy and DPA
Processing of personal data for which the Provider acts as controller is described in the Privacy Policy. Use of necessary and optional technologies is described in the Cookie Policy.
Where the user acts as controller of personal data and the Provider processes third-party personal data on the user's behalf in connection with EZINDRA, the Data Processing Agreement (DPA) forms an integral part of the agreement and applies to the extent described in that DPA.
12. Availability, maintenance and service changes
The Provider uses reasonable efforts to keep EZINDRA available and operating properly but does not guarantee uninterrupted or error-free operation. Interruptions may result from maintenance, updates, failures, infrastructure-provider actions or events outside the Provider's reasonable control.
The Provider may modify functions or operation of EZINDRA only for valid and objective reasons, such as changes in law, security, abuse prevention, technological development, compatibility or interoperability, performance improvements, infrastructure changes, or the introduction, improvement or discontinuation of features as part of service development. For consumers, a modification going beyond what is necessary to maintain conformity with the contract will be made only to the extent permitted by applicable law and on the grounds stated above, without additional cost where required by law.
The Provider will inform users clearly and understandably about material changes. Where mandatory consumer law requires advance notice on a durable medium, a specified notice period, the ability to retain an unchanged conforming service, or a right to terminate because a modification materially and negatively affects access to or use of the service, the Provider will provide those rights. For consumers covered by EU/EEA digital-service rules, the statutory 30-day termination period also applies where the conditions for that right are met, subject to the applicable statutory exceptions.
13. Suspension and termination
The Provider may temporarily restrict or suspend access where reasonably necessary to protect security, prevent abuse, comply with a legal obligation, contain an incident, or address a material or repeated breach of these Terms.
Where circumstances permit, the Provider will inform the user of the reason and provide a reasonable opportunity to remedy the breach before permanent termination. This is not required where immediate action is necessary for security or legal reasons or where notice is prohibited by law.
The user may stop using EZINDRA and delete the account through the available account functions. Cancellation of a paid subscription is governed by section 7 of these Terms. Termination does not affect obligations, rights or claims that by law or their nature continue after termination, including lawful data-retention periods.
14. Complaints and support
Complaints concerning EZINDRA or performance of the agreement may be submitted electronically to the Provider's contact address. Where possible, the complaint should include information sufficient to identify the account, a description of the issue, relevant circumstances and the requested resolution.
The Provider will acknowledge or handle complaints without undue delay and respond within the time and in the form required by mandatory law. Submitting a complaint does not limit the user's statutory rights or access to a competent authority or court.
15. Liability
The user is responsible for the accuracy and lawfulness of data, prices, rates, taxes, customer details, content and documents created using EZINDRA, and for reviewing them before use or disclosure to third parties.
To the extent permitted by law, the Provider is not liable for consequences caused by incorrect user data or instructions, unlawful use of the service, third-party systems or services outside the Provider's reasonable control, or force-majeure events. Nothing in these Terms excludes or limits liability to the extent such exclusion or limitation is prohibited by law.
16. Changes to these Terms
The Provider may amend these Terms only for a valid and objective reason, including a change in law or a binding interpretation of law, a change to EZINDRA functions requiring these Terms to be updated, security requirements, abuse prevention, a change of provider or infrastructure affecting the terms of service, or the need to correct an ambiguity or error in these Terms. An amendment will not apply retroactively or deprive the user of accrued rights.
For an amendment affecting an ongoing agreement, the Provider will give appropriate advance notice in the manner required by applicable law. If the law requires a durable medium, a particular notice period or the user’s express consent, those requirements will be followed.
If an amendment to an ongoing agreement affects the user’s rights or obligations and the user does not accept it, the user may terminate the agreement before the amendment takes effect to the extent that such a right arises under applicable law or is stated in the notice. Changes to the digital service itself for consumers are additionally subject to section 12 of these Terms.
17. Governing law and disputes
The agreement is governed by Polish law, subject to mandatory provisions that apply irrespective of a choice of law.
The choice of Polish law does not deprive a consumer of protection granted by provisions that cannot be excluded by agreement and that would apply in the absence of the choice. For consumers and other persons protected by mandatory jurisdiction rules, court jurisdiction is determined by those mandatory rules.
For disputes with users who are not consumers and are not otherwise protected by mandatory jurisdiction rules, the courts of Poland have exclusive jurisdiction and, to the extent permitted by applicable law, venue lies with the court having territorial jurisdiction over the Provider’s registered office or place of establishment.
Before bringing a dispute to court, the parties may attempt to resolve it by contacting the Provider. Consumers may also use competent out-of-court dispute-resolution mechanisms where available under applicable law.
